Purposes and Legal Bases of Processing

The personal data collected are processed for various purposes, each based on specific legal grounds pursuant to Article 6 of Regulation (EU) 2016/679 (“GDPR”).

a) Browsing Data
The IT systems and software procedures used to operate the Website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.
This information is not collected to be associated with identified individuals, but by its very nature could, through processing and association with data held by third parties, allow users to be identified.
This category of data includes IP addresses or domain names of the computers used by users connecting to the Website, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s response (successful, error, etc.), and other parameters related to the user’s operating system and IT environment.

The Company processes the above-mentioned data to ensure that the website is up to date and meets users’ needs. In addition, the Company uses the data to guarantee the security of the website and its users, as well as to protect the rights and/or assets of the Company (legitimate interest).

b) Access to the Authenticated Platform “Control Center”
The data are processed to allow access to the authenticated area reserved for customers. Access is granted exclusively through personal credentials (username and password), which are encrypted and managed through an external platform.

The Company processes the authentication data for the platform on the basis of the contract with the Customer. Failure to provide such data will make it impossible to access the reserved platform.

c) Data Provided by the User
Certain data are processed in order to respond to requests received through the website. In this case, the Company processes the data for the purpose of executing pre-contractual or contractual measures with users who have requested information or submitted commercial proposals. The data collected (name, surname, email address) through the contact forms are entered into MLS’s internal records for the management of communications and of the relationship resulting from the request. Failure to provide such data makes it impossible to establish or manage a pre-contractual or contractual relationship with the data subject.

Providing data for this purpose is necessary, and any refusal by the user will prevent the Controller from fulfilling its contractual obligations and from providing the user with the requested functionalities, services, and information.

Data Retention Periods

a) Browsing data are retained for the time strictly necessary for the technical management of the website and, in any case, no longer than 30 days, unless required for the investigation of criminal offences by the judicial authorities.

b) Data relating to the reserved area are retained until the user unsubscribes or, in case of inactivity, for a maximum of 5 years, subject to verification.

c) Data collected for the management of requests submitted via the website are retained for the entire duration of the commercial negotiation.

Data Transfer Abroad

The data are processed and stored on servers located within the European Union.

Data Subject Rights

The user may, at any time, exercise the following rights (Articles 15–22 of the GDPR):

  • Right of Access – to know whether processing of personal data is taking place and to obtain a copy of such data.
  • Right to Rectification or Update – to correct inaccurate data or update personal information.
  • Right to Erasure (“Right to be Forgotten”) – to request the deletion of personal data in the cases provided for by the GDPR.
  • Right to Object – to object, on legitimate grounds, to the processing of personal data.
  • Right to Restriction of Processing – to request the limitation of personal data processing in specific circumstances.
  • Right to Data Portability – to receive personal data in a structured format and to transmit them to another controller.
  • Right to Withdraw Consent – the user may withdraw previously given consent for direct marketing activities at any time. Such withdrawal shall not affect the lawfulness of processing carried out before its withdrawal.
  • Right to Lodge a Complaint – to submit a complaint to the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali, www.garanteprivacy.it) if it is believed that the processing of personal data is not compliant with the GDPR.
